Truvista Tech Referral Program

Terms and Conditions

Truvista Communications, Inc. (“Truvista Fiber,” “Company,” “we,” “our,” or “us”) is offering eligible participants the opportunity to participate in the Truvista Fiber Technician Referral Program (“Program”) through referral links and related promotional activities hosted through Truvista Fiber and/or its referral platform provider.

By accessing, participating in, or using the Program, all participants agree to be bound by these Terms & Conditions (“Terms”). All Company decisions regarding the Program are final and binding.

  1. Eligibility

To participate in the Program, participants must:

  • Be legal residents of the United States
  • Be at least eighteen (18) years of age
  • Comply with all applicable federal, state, and local laws
  • Comply with all Truvista Fiber policies and procedures

Participation is void where prohibited by law.

The Program is intended for personal, individual participation only and may not be used for commercial solicitation or unauthorized sales activity.

  1. Program Overview

Eligible Truvista Fiber technicians (“Referrers”) may share approved referral links (“Personal Link”) with prospective new residential customers (“Customers”).

To qualify:

  • The Customer must use the referral link provided by the Referrer
  • The Customer must place a qualifying order for new Truvista Fiber broadband service
  • The order must be completed, fulfilled, installed, and activated
  • The referral must comply with all Program requirements

Once a referral is validated and installation is completed, eligible rewards may be issued to both the Referrer and Customer as outlined in the applicable promotion.

Only new residential broadband activations qualify unless otherwise specifically stated by the Company.

Existing customers, account transfers, upgrades, duplicate accounts, fraudulent accounts, or canceled orders are not eligible unless expressly approved by the Company.

The Company reserves the right to determine final eligibility in its sole discretion.

  1. Referral Requirements and Validation

Referral payouts are based on booked and completed qualifying orders.

Additional requirements include:

  • The referred order must be placed within thirty (30) to sixty (60) days of referral submission, as determined by the Company
  • Service must remain active and in good standing
  • The referred Customer must not have previously subscribed to Truvista Fiber services at the same address within a timeframe determined by the Company
  • Referral activity may be reviewed for fraud, abuse, or misuse prior to payout

Users may refer a maximum of twenty-five (25) Customers during each session and a maximum of five hundred (500) referrals during the lifetime of the Program unless otherwise approved by the Company.

The Company may delay, deny, revoke, or adjust rewards pending investigation or verification.

All validation, measurement, eligibility determinations, and performance calculations will be made solely by the Company using internal systems and records.

  1. Technician Incentive Payments

Eligible Referrers may receive incentive compensation for qualifying referrals as identified in the active promotional materials.

Technician incentive payments:

  • Will be processed through payroll
  • Will be paid once per month through the normal commission cycle
  • Are considered taxable wages
  • Will be subject to all applicable federal, state, and local tax withholdings

Referrers are solely responsible for all tax obligations related to rewards or incentive compensation.

  1. Customer Rewards

Eligible Customers may receive a $25 promotional reward after:

  • Successfully using the referral link
  • Completing installation and activation of qualifying service
  • Meeting all eligibility requirements

Customer rewards:

  • Will only be issued after installation and activation are completed
  • Must be redeemed within ninety (90) days of issuance
  • May expire and be revoked if not redeemed within the redemption period
  • Are non-transferable and not redeemable for cash unless required by law

The Company reserves the right to withhold, revoke, or cancel rewards associated with fraudulent activity, canceled accounts, service disconnects, or violations of these Terms.

  1. Restrictions and Prohibited Conduct

Participants may not:

  • Refer themselves
  • Create multiple, fictitious, duplicate, or fraudulent accounts
  • Misrepresent Company products, pricing, promotions, or policies
  • Use spam, bots, scripts, automated systems, mass distribution, or deceptive practices
  • Violate any law, regulation, or third-party rights
  • Engage in conduct deemed harmful, harassing, abusive, illegal, obscene, deceptive, or outside the intended spirit of the Program

All participants must comply with all applicable Company policies, including but not limited to:

  • Code of Conduct
  • Sales Practices policies
  • Ethics policies
  • Customer Privacy policies
  • Data Security policies

Violations may result in:

  • Immediate disqualification
  • Loss of rewards
  • Removal from the Program
  • Disciplinary action up to and including termination
  • Legal action where applicable

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE, ABUSE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY VIOLATE CRIMINAL AND CIVIL LAWS. THE COMPANY RESERVES THE RIGHT TO SEEK DAMAGES, ATTORNEY FEES, AND OTHER REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.

  1. Bulk Distribution and Spam

Each Referrer is the actual sender of any referral communication and is responsible for complying with all applicable laws, including anti-spam and marketing laws.

Referral messages must be distributed:

  • Personally
  • Appropriately
  • Only to individuals with whom the Referrer has a relationship or appropriate consent

Bulk email distribution, unsolicited outreach, automated messaging, or distribution to strangers is prohibited.

By submitting any Customer information, the Referrer represents that they have obtained all necessary permissions and consent.

The Company reserves the right to:

  • Block referral activity
  • Remove content
  • Disable referral links
  • Disqualify participants engaging in prohibited conduct

Participants who violate anti-spam laws or related regulations agree to indemnify and hold harmless the Company and Program entities from any liabilities, claims, damages, or expenses arising from such conduct.

  1. Privacy

Personal information collected, processed, or used as part of the Program will be handled in accordance with Truvista Fiber’s Privacy Policy and applicable laws.

  1. Sign-In Credentials

Participants are responsible for maintaining the confidentiality of any login credentials associated with the Program and are fully responsible for all activities conducted through their accounts.

Participants agree to notify the Company immediately of any unauthorized access or suspected misuse.

The Company is not responsible for losses resulting from unauthorized use of accounts or credentials.

  1. Program Modifications and Termination

The Company reserves the right to:

  • Modify, suspend, extend, restrict, or terminate the Program at any time
  • Modify reward structures, eligibility requirements, or promotional periods
  • Cancel rewards or participation due to fraud, abuse, technical issues, business needs, or circumstances beyond its reasonable control
  • Disqualify any participant who violates these Terms or Company policies

All Company decisions are final.

  1. Disclaimer of Warranties

THE PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.

The Company does not guarantee:

  • Continuous Program availability
  • Error-free operation
  • Successful referral tracking
  • Delivery or redemption of rewards without verification
  • That the Program will meet participant expectations

Participation is at the participant’s own risk.

  1. Limitation of Liability

By participating in the Program, participants agree to release, indemnify, and hold harmless Truvista Fiber LLC, Extole, Inc., and their respective affiliates, subsidiaries, officers, directors, employees, contractors, agents, licensors, representatives, and service providers (“Released Parties”) from any claims, damages, liabilities, losses, costs, or expenses arising from participation in the Program or use of any reward.

The Released Parties shall not be liable for:

  • Technical malfunctions
  • System outages
  • Data loss or corruption
  • Delayed or failed referrals
  • Typographical or administrative errors
  • Unauthorized access
  • Lost, stolen, delayed, expired, or misdirected rewards
  • Damage to devices or systems related to Program participation

To the fullest extent permitted by law, the Released Parties’ maximum liability arising from the Program shall not exceed one hundred dollars ($100).

  1. Acceptance of Terms

Participation in the Program constitutes full and unconditional acceptance of these Terms & Conditions and all decisions made by the Company regarding the Program.
